| Designer Music is a UK music business and abides by the laws of this country. |
| Definitions:
· "we", "us", "our", refers to Designer Music · "you", "your", refers to the customer. · "services" refers to any of the following created by Designer Music: arrangements, compositions, printouts, recording services, ‘Tutor Finder’ and ‘Musician Finder’. · "client" refers to anyone using a Designer Music service. · "products", "items" refers to all goods within the Designer Music online shop. · "tangible goods" refers to all physical products that you can touch. · "non-tangible" products refers to digital products, ie. downloads. · "tutors" refers to school music teachers or private music teachers. · "musicians" refers to performing musicians, arrangers or composers. · "members" refers to customers, or tutors and musicians who wish to, or already have, registered their skills with us. |

| Returns: Products may only be returned if they have been damaged during transit. Such products must be posted back to us within 3 days of receipt. We will either send you a like for like replacement or offer a suitable exchange. In either case we will refund the cost of returning the product(s) to us (using 2nd Class postage costs). Please also note that any replacement items cannot subsequently be exchanged themselves unless damaged in transit. |
| Refunds: No refunds or exchanges will be offered for any Designer Music downloads or Designer Music 'A4 Print' products bought from our online shop. No refunds will be given for any non-Designer Music tangible products bought from our online shop. However, if you return any such items in their original condition within 15 days of purchase, we’ll gladly exchange them for a different product of equal value. However, such replacement items cannot subsequently be exchanged themselves. The customer's statutory rights are not affected. Products from other publishers/distributors sold in our online shop (including books, sheet music, CDs and other music media). |
| Designer Music Services: 1. Following the submission of a no-obligation order for a Designer Music service, the customer will receive a quotation email outlining the cost of the service together with the estimated time your order will take to complete. Customers accept a quotation for a Designer Music service by providing payment details. This can be done online by clicking the link in the quotation email, phoning the telephone number given in the quotation email, or by sending the relevant information through the post to the address given in the quotation email. Payment may be made by cheque or credit/debit card. Designer Music will not process any payment until the service has been completed and is ready for dispatch. |
| 2. The customer may
cancel an order for a Designer Music service at any stage during
the creation of the service. However, the customer may be charged
up to 80% of the original quotation cost depending upon how much
of the service has been completed. Designer Music will determine
the amount payable. |
| 3. a) Once the customer
has received the finished service, Designer Music will be obliged,
at no extra cost, to make any reasonable alterations, amendments
and/or additions to the completed service at the customer’s
request. Designer Music may even decide to completely redo the
service, starting from scratch again. This however will be always
at the discretion of Designer Music and the customer can only
make recommendations. b) After receiving any alterations, amendments and/or additions to the completed service, the customer may request further reasonable changes, again within 7 days of receiving the amended service. c) If, after these second amendments have been made, Designer Music may agree to even further changes or will issue a refund of up to 20% of the original quotation cost. Designer Music will determine the amount of refund payable. All material produced by Designer Music in attempting to complete the service satisfactorily, will remain with the customer. |
| 4. The copyright for any tangible
or non-tangible material produced by Designer Music will remain
with Designer Music. However, the customer is permitted to make
any changes to the finished products themselves. Designer Music
will not retain the copyright for any changes made by the customer
and will not be held responsible for offence, damage or infringement
of copyright caused as a result of those changes. |
| 5. The customer may photocopy/print
out/reproduce copies of any services produced by Designer Music
for those who were intended to originally benefit from the service
as outlined by the customer in his/her original service order.
However, no charge must be made for such reproductions, and under
no circumstances must any service produced by Designer Music be
sold on to any third party by the customer. Any Designer Music
materials produced must not be forwarded on to anyone who was
not originally intended to benefit from the service as outlined
by the customer in his/her original order. |
| 6. Designer Music will print/record services using good quality materials. If the customer requires special materials, for example heavily textured paper or unusual recording media, the customer must inform Designer Music at the order stage. Costs maybe adjusted accordingly. |
| 7. If Designer Music cannot complete a service for whatever reason, the customer will be advised and no payments authorised by the customer will be processed. Please remember, payments are only processed once a service has been completed and is ready for dispatch. |
| 8. 'Tutor Finder' and 'Musician Finder' are both
introductory services only and in no way, shape or form constitute
a recommendation of that tutor or musician, and Designer Music will
not be held responsible for any problems, loss or damage which may
arise through our introduction. We therefore thoroughly urge all
customers using either service to interview the tutors or musicians
they are seeking to use, especially if they will be working with

| Tutors and Musicians Designer Music is not an agency, just an introductory service. We are happy for members to have agents in addition to their Designer Music membership. |
| If a client requires either a musician or tutor and more than one of our registered members is suitable and available for the job, we will supply the client with each suitable member's details in order for them to decide the member they wish to employ. Designer Music will not show favouritism to any one particular member; the client always makes the final choice. |
| Designer Music does not employ any of its members and will not be held responsible for payment due to its members. The client is responsible for paying the member according to the member's own payment conditions. |
| The member can charge their own rates for any service provided but must state these rates to Designer Music at the time of their registration. |
| Copyright Designer Music is determined to defend copyright and the interests of musicians in general. Therefore if necessary, we will check the copyright status, where appropriate, for sheet music submitted to us for any of our services. If there are copyright restrictions, there may be additional charges to be made. Some copyright owners may allow their music to be printed, arranged or recorded for educational purposes but may insist that any files produced are destroyed after they have served their purpose. On rare occasions, the printing, arranging or recording of a piece may even be prohibited. Any copyright restrictions including charges, will be advised to the customer before any service is completed. No payment may be made by the customer until copyright issues have been determined. |
| Limitation of Liability: In no event shall Designer Music and its respective officers, directors, employees, representatives, or agents be liable for direct, special, incidental, consequential, punitive, or indirect damages (including but not limited to, loss of data, use, or profits), however caused, whether for breach of contract, negligence, or otherwise, and whether or not Designer Music has been advised of the possibility of any such damages. By making any purchase through the Designer Music web site, you agree that the company parties’ maximum liability arising from any product sold shall not exceed the price of such product, except to cover reasonable postage costs. Some jurisdictions do not allow the limitation of exclusion of liability for certain damages so the above limitations and exclusions may not apply to you to the extent such jurisdictions law is applicable to this agreement. |
